Terms of Use and Privacy Policy Information for Non-registered Users

The Institute for Research on East and Central European History and Society (1122 Budapest, Határőr út 35; Tax Number: 18237010-2-43; hereinafter referred to as: Service Provider) is the exclusive owner and manager of information displayed on the website http://www.emlekpontok.hu/en/news (hereinafter referred to as: Website). The use of the service (hereinafter referred to as: Service) provided by the Service Provider is permitted only under the following terms and conditions, and only in accordance with the privacy policy of the Service Provider and the legislation of the Republic of Hungary.

Under the framework of the implementation of the project titled "Emlékpontok, an Audio-visual Memory Collection" (SROP-3.2.9-08/1/A-2009-0002) the Website serves to help inter-generation knowledge transfer and preserve the historical observations and experiences of families and small communities, the transfer of which, through the telling of history, was interrupted by the totalitarian systems of the recent past, by recording and publishing oral history interviews.

Rights regarding the administration of personal data on Website and data deletion

The Service Provider shall only administer and publish on the Website personal data of interviewees and any third person included in the interview (hereinafter referred to as: Participant) based on voluntary and explicit written consent.

The participant may request information about the administration of his/her personal data. Upon request, the data manager shall within 30 days, provide written information to those concerned about the data under his/her administration; the purpose of the data management, its legal basis, duration, the name of the data processor, address (headquarters), activities related to the data management, as well as information about who will or has obtained access to the data and for what reason. Anyone providing proof of involvement and a mailing address may request such information from the data manager via the mailing address or via the e-mail address emlekpontok@emlekpontok.hu.

A Participant may request a copy of the video containing his/her personal data, may object to the management of personal data, and within this framework may request correction or deletion of personal data via the data manager's postal address and/or the e-mail address emlekpontok@emlekpontok.hu.

Data deletion or modification requested by e-mail will take place within 3 working days of the receipt of the request at latest.

Non-registered users of the Website may read public content as well as make comments in the guestbook.

Videos in our Website are for personal use only, and Users may not copy, distribute, or alter the videos.

The User may not use the service to harass, slander, defame, or violate the dignity or constitutional principle of equality, or in any way compromise personal or other rights of other users or video Participants.


While viewing the Website certain visitor data is automatically collected: the user's entry and exit time and in some cases — depending on the user's browser settings — the browser type, the operating system specifications, the user's IP address, and the entry and exit URL. The system automatically generates statistical data from this information. The data manager does not correlate this information with other personal data and it is used exclusively for generating statistics of Website traffic.

By using the Website, the user consents to the processing of his/her personal data by the data manager.

Modification of the Terms of Use

The Service Provider reserves the right to unilaterally modify the Terms of Use with prior notification to the users. Upon first entering the Website following the modification of the Terms of Use of the service you accept the modifications.

Registration

Registered users are entitled to visit the Website and submit comments in forums. Users must provide a username, e-mail address, and password as part of the registration process. The user shall bear the responsibility for maintaining the confidentiality of his/her password.

By registering, the user declares that his/her ability to conclude agreements is not limited, and consents to disclose to the Service Provider some certain limited information about himself or herself that is current, authentic, and complete.

Services may only be used by natural persons above the age of 14. Users under the age of 14 may use the Service only under parental supervision.

If the data provided by the user for identification is misleading, the Service Provider reserves the right to verify the user's identity and user data by requesting the user to present suitable photo identification in order to prevent use of misleading identification. You agree to respond to the e mail sent to you for verifying your identity within 24 hours; otherwise your user status may be canceled. During the time between the alleged use of misleading identification and finishing of the verification process, user access may be limited. The Service Provider shall not be held responsible for damages resulting from non-compliance with this obligation.

Information related to one account, including the username, comments, finished metadata, and optional data is public.

The user's password and e-mail address are not public and are not accessible by third parties. In case of lost or forgotten password, the system can resend the password to the user, upon request, if the user specifies the e-mail address used for identification or given at the time of registration.

Information about Comments

Please note that by posting and/or commenting you consent to others handling (recording, using, republishing, etc.) the personal data being published by way of your post, comment, and or message. From the information provided in posts, others may draw conclusions about the person making the post that are not necessarily true, concerning, for example, political opinions, world views, or national or ethnic origin. The jurisdictional basis for the processing of information published by the commenter is the presumption specified in Act LXIII of 1992 on the protection of privacy and disclosure of data of public interest Section 3. § (5), according to which the subject must consider to have given consent in the process of publicly disclosing or publishing information. The data manager considers remarks in posts and messages to be public expressions, and therefore, may make them available to the public for an unlimited period and shall not be required to remove or delete them either at the incidental request of subject or in the case of the user requesting the deletion of his/her own data.

By accepting these terms of use you agree not use the service to harass, slander, defame, or violate the dignity or constitutional principle of equality, or in any way compromise personal or other rights of other users or Participants. The Service Provider reserves the right to delete, or limit the user accounts or to suspend those functions, which are used to harass other individuals, either on message board, in the form of personal messages, in lists, through the content presented by the service or on any other public interface or manner.

The user is obliged to take all reasonable steps to protect his/her personal data, especially the password required to access the service provided by the service provider. The user is responsible for all events and activities that take place under the use of his/her username and password.

Content

You are fully responsible for the content, and the consequences thereof, that you place or display on the Website within the framework of the Service, including but not limited to photographs, personal data, conversations, lists, and personal messages. The Service Provider does not automatically scrutinize the content placed, displayed, or published by users and is not responsible for information forwarded.

By accepting the Terms of Use you accept that the Service Provider may, without notice and within its own cognizance, remove any material or reference to material which is illegal, conflicts with the personal rights of other persons, is fraudulent, threatening, libelous, slanderous, obscene, or otherwise objectionable, as well as anything which may infringe upon or breach the intellectual property rights, copyrights or other related property rights of another party or the provisions of this Terms of Use.

The Service Provider, without any notification, shall be entitled to remove from the Website such material or references which can be considered the creation or forwarding of unwanted electronic communication, such as "spam" or the disturbance of other users during the use of the service, including but not limited to offending photos, disturbing, aggressive, or "off-topic" comments, and repetition of such comments under multiple topics distributed over a short period of time. Repetitions of postings shall be deleted leaving only the original.

The Service Provider reserves the right to delete without any further notice, accounts of users who misuse the name, likeness, e-mail address, or the personal details or information of any other person, in particular if the user presents content through the service, which:

  • infringes upon a trademark,
  • is that of a public figure, name of a publicly know individual, except when the user's official name is the same as such,
  • violates the name or legitimate interest of any other person,
  • is crude or obscene,
  • is racist, or violates or offends the religious, national, ethnic, sexual, political or philosophical identity,
  • qualifies as implied or open advertising.

The Service Provider is not responsible for the accuracy, content, completeness, legality, or reliability of information or material posted on the Website by users or for the behavior of users on the Website.

By accepting the Terms of Use, you acknowledge that you use the applications displayed on the Website exclusively at your own risk and that the Service Provider accepts no responsibility for incidental property and non-property damages incurred during its use.

Modification of the Terms of Use

The Service Provider reserves the right to unilaterally modify the terms of use with prior notification of the users. Upon first entering the Website following the modification of the Terms of Use of the service you accept the modifications.


Privacy Policy (short summary)

Privacy Policy shall apply to the Institute for Research on East and Central European Historical and Society (hereinafter: Institute), "Emlékpontok – Audio-visual Memory Collection" project and all persons involved in the project.

This policy shall also apply to persons who, based on any form of authorization, are entitled to manage registered personal data, use systems containing such data, perform entry, processing, forwarding, or deletion of data, or perform technical operations or maintenance on the system. The Institute is the manager of the data covered by the Privacy Policy.

The purpose of the data management is the implementation of the project "Emlékpontok –Audio-visual Memory Collection", which serves transfer and preserve the historical observations and experiences of families and small communities, the transfer of which, through the telling of history, was interrupted by the totalitarian systems of the recent past, by recording and publishing oral history interviews. It also aims at supporting the inter-generational transfer of knowledge in such a way that strengthens one's sense of the right to self-determination. The project aims to achieve educational, social self-knowledge, and local history goals. It is not a scientific research, but it lends the resulting archival material for scientific research (video library and related documentation).

The legal basis for the data management is the subject's explicit written consent in which the subject agrees that the Archive would manage his or her personal and specific data, and publish them on the World Wide Web or make it publicly available in any other form for educational or scientific purpose.

Teachers participating in the project shall take part in data protection training during which they would become familiar with the Privacy Policy. They shall, by declaration, commit themselves to informing the students under their supervision of the professional requirements and privacy constraints of producing oral history interviews.

Only students who are not incapable (14 years of age) may take part and who — in accordance with the rights of minors specified by international and domestic law — sign a declaration of intention to participate in the program and that they are aware of and will comply with the data protection requirements.

During and after the interview, protection of personal information of the interviewee and of third persons must be observed. During the interview, specific information (such as religious belief, ethnicity, and political opinion) may also come to light. The legality of retaining this information shall be examined by both the head teacher and the Institute Archive. Data not legally recorded must be deleted prior to inclusion in the data store.

The published version of the interview must be made anonymous (e.g.: born: 1947, Bicske, male, farmer), unless the interviewee has consented to personal information being presented in the interview. The interviewee shall consent with the understanding that when the recording is made public, he or she may be identifiable in absence of personally identifying information.

"Emlékpontok –Audiovisual Memory Collection" project does not keep records about online users.
